ALLMILES Terms and Conditions

• By downloading, registering, or using the AllMiles mobile application (“App”), you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions. If you do not agree to these Terms, you must not register for or use the AllMiles App or its services.
• To proceed with registration and access the App, you will be required to confirm your acceptance of these Terms by selecting the checkbox/tick mark (“I Agree”). This action constitutes your valid consent and creates a binding agreement between you and AllMiles.
• It is your responsibility to read and understand the Terms & Conditions (“T&C”) governing the use of the AllMiles mobile application and services. By using the App, you acknowledge that AllMiles shall not be liable for any consequences arising from your failure to review the T&C.
• The T&C may be updated or amended from time to time. Continued use of the App after such updates constitutes your acceptance of the revised terms. We encourage you to review the T&C periodically to remain informed of any changes.

• The AllMiles Platform enables Users to request, schedule, and use taxi, cab, rickshaw, bus, and related transport services facilitated through registered driver-partners (“Kaptans/Drivers”).
• AllMiles acts as an intermediary/aggregator connecting Users with Kaptan/Drivers. We are not a transport service provider and do not own vehicles. The responsibility for safe and lawful operation of rides lies with the Kaptan/Driver.
• Users must be at least 18 years old and legally capable of entering into contracts under Indian law.

• You must register with valid personal details including mobile number, email ID, and payment information.
• You are responsible for maintaining the confidentiality of your account and all activities conducted under your account.
• Providing false or misleading information may result in suspension or termination of services.

• By using the Platform, you consent to the collection, storage, and processing of your personal information, including but not limited to:

  • Name, contact details, and profile information.
  • Location/GPS data (during rides and app usage).
  • Payment details processed via secure third-party gateways.
  • Ride history, preferences, and feedback.
• AllMiles will process your data in compliance with the Indian IT Act, 2000, the Digital Personal Data Protection Act, 2023, and global best practices.

• Data may be shared with:

  • Kaptans/Driver for trip fulfilment.
  • Payment processors, insurers, and regulatory authorities as required.
  • Law enforcement/government authorities, if legally mandated
• You have rights to access, correct, or request deletion of your personal data by writing to support@allmiles.in.

• The fare for each ride will be calculated and displayed on the AllMiles App prior to booking confirmation, based on distance, time, applicable taxes, surcharges, and other pricing parameters as determined by the Company in accordance with applicable regulations.
• By confirming a booking, you acknowledge and agree to the fare displayed on your screen at the time of booking. Once accepted, such fare shall be final and binding, and you shall not dispute or challenge the fare thereafter.
• Additional charges such as tolls, parking fees, waiting charges, and state border crossing charges (if applicable) are exclusive of the displayed fare and shall be payable by you at actuals, either directly to the Driver/Kaptan or as part of the final fare charged through the App.
• AllMiles reserves the right to revise its fare structures, introduce dynamic pricing, or update fee schedules from time to time, and such revisions will be reflected on the App. Continued use of the Platform constitutes acceptance of the revised fare term.

• The AllMiles Platform is intended for the carriage of passengers and their personal luggage only.

• Kaptans/Driver may, at their sole discretion, refuse to transport:

  • Bulky goods, hazardous materials, or items not ordinarily carried in a passenger taxi.
  • Animals or pets, except as required by law for service/support animals.
• If a Kaptan/Driver agrees to carry such items or animals, it shall be strictly at the Passenger’s risk and discretion of the Kaptan/Driver. AllMiles shall not be responsible or liable for any loss, damage, injury, inconvenience, or claim arising from such carriage.
• Passengers are strictly prohibited from carrying any unlawful, prohibited, or dangerous goods, including but not limited to weapons, explosives, inflammables, or contraband.

• By registering, you consent to receive transactional communications (SMS, email, WhatsApp, push notifications) related to your bookings.
• You may separately opt-in to receive promotional/marketing communications including offers, discounts, and updates. You may withdraw such consent anytime by unsubscribing.

• You must not misuse the Platform or engage in unlawful activities, including but not limited to:

  • Abusive behaviour towards Kaptans/Drivers or support staff.
  • Non-payment of fares.
  • Providing false location or ride details.
  • Attempting to circumvent payment systems.
• AllMiles reserves the right to suspend or terminate your account in case of misuse or violation of these Terms.

• All fares, cancellation charges, tolls, and parking fees are determined as per the Cancellation & Refund Policy, which forms part of these Terms.
• Payments may be made via cash, card, UPI, wallet, or other approved modes.
• Applicable taxes (GST, local levies) will be added as required by law.

• AllMiles provides an intermediary service only and does not assume responsibility for:

  • The conduct, actions, or omissions of Kaptans/Drivers
  • Delays, cancellations, or accidents beyond our reasonable control
• Our liability is limited to the amount paid by you for the specific booking in dispute. We are not liable for indirect, incidental, or consequential losses (including missed flights, lost opportunities, or damages).
• AllMiles acts solely as a technology platform that connects passengers with independent Kaptan/Driver partners. The actual transportation service is provided by the Kaptan/Driver, who is responsible for complying with all laws, safety standards, and professional conduct.

• While we strive to ensure a smooth experience, AllMiles shall not be liable for any delay, inconvenience, loss, or damage arising from factors beyond our reasonable control, including but not limited to:

  • Traffic congestion, road closures, diversions, or accidents.
  • Delay or cancellation by the Kaptan/Driver.
  • Vehicle breakdown, fuel shortage, or mechanical failure.
  • Weather conditions, natural calamities, or public disturbances.
  • Compliance checks or restrictions imposed by government authorities.
• In no event shall AllMiles be liable for indirect, incidental, or consequential losses, such as missed flights, lost business opportunities, or personal inconvenience.

• Indemnity: By using the Platform, you agree to indemnify and hold harmless AllMiles, its directors, employees, and affiliates against any claims, liabilities, or expenses arising from:

  • Your breach of these Terms,
  • Your misconduct towards a/Kaptan/Driver or third party, or
  • Any demand or claim made by a Kaptan/Driver, authority, or third party arising from your use of the Platform.
• Our liability in all circumstances shall be limited to the fare paid by you for the specific booking in dispute.

• Kaptans/Drivers are prohibited from using alcohol, drugs, or any impairing substances while logged into the Platform.
• Users must also behave respectfully and avoid harassment, abuse, or unlawful behaviour. Violations may result in suspension and legal action.

All intellectual property in the Platform (logos, software, content, trademarks) belongs to AllMiles. Users may not copy, reproduce, or misuse any content without prior written consent.

AllMiles may suspend or terminate your access if:

• You breach these Terms
• Required by law or regulatory authority
• Misuse of services is detected

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai.

AllMiles may update or amend these Terms at any time. Updates will be communicated through the app or website. Continued use of the Platform constitutes acceptance of the revised Terms.
